User Agreement

The Digital Cheetah online store, available at digital-cheetah.com and represented by Artem Yuryevich Belikov (hereinafter, the “Seller”), hereby publishes this Public Offer for the distance sale of Goods.

  1. DEFINITIONS

1.1. A public offer (hereinafter, the “Offer”) is a public proposal by the Seller, addressed to an indefinite number of persons, to enter into a distance sales agreement with the Seller (hereinafter, the “Agreement”) under the terms set out in this Offer, including all appendices.

1.2. An Order for Goods on the Online Store website means the items selected by the Buyer from the range of Goods offered for sale when submitting a request to purchase Goods through the Online Store website or through an Operator.

  1. GENERAL PROVISIONS

2.1. By ordering Goods listed on the Online Store website, the Buyer agrees to all terms of this Offer.

2.2. The administration of the Online Store website may amend the Offer without notifying the Buyer.

2.3. The Offer remains valid indefinitely unless otherwise stated on the Online Store website.

2.4. The Seller provides the Buyer with complete and accurate information about the Goods on the relevant product-description page of the Online Store website, including information about their main consumer characteristics, place of manufacture, warranty period, and expiration date.

  1. PRICE OF GOODS

3.1. The price of each item is stated on the Online Store website.

3.2. The Seller may unilaterally change the price of any item.

3.3. If the price of ordered Goods changes, the Seller must notify the Buyer of the change within five days.

3.4. If the Seller changes the price after the Order has been placed, the Buyer may confirm or cancel the Order.

3.5. The Seller may not change the price of Goods that the Buyer has already paid for.

3.6. The Seller states the delivery cost on the Online Store website or informs the Buyer when an Operator processes the Order.

3.7. The Buyer’s payment obligation is fulfilled when the Seller receives the funds.

3.8. The Buyer must pay for the Goods using one of the payment methods specified on the Online Store website.

  1. PLACING AN ORDER

4.1. The Buyer places an Order for Goods through the services available on the Online Store website at digital-cheetah.com.

4.2. When registering on the Online Store website, the Buyer must provide the following information:

4.2.1. Email address.

4.3. The name, quantity, range, stock-keeping unit, and price of the Goods selected by the Buyer are shown in the Buyer’s shopping cart on the Online Store website.

4.4. If the Seller requires additional information, the Seller may request it from the Buyer. If the Buyer does not provide the required information, the Seller is not responsible for the Goods selected by the Buyer.

4.5. When placing an Order through an Operator under Clause 4.1 of this Offer, the Buyer must provide the information specified in Clause 4.2 of this Offer.

4.6. The Buyer accepts the terms of this Offer by entering the required information in the registration form on the Online Store website or by placing an Order through an Operator. After an Order is placed through an Operator, the Buyer’s information is recorded in the Seller’s database. By confirming the Order for the selected Goods, the Buyer provides the Operator with the information required under Clause 4.2 of this Offer.

4.7. The Seller is not responsible for the content or accuracy of the information provided by the Buyer when placing an Order.

4.8. The Buyer is responsible for the accuracy of the information provided when placing an Order.

4.9. A distance sales agreement between the Seller and the Buyer is concluded when the Seller receives notice of the Buyer’s intention to purchase the Goods.

  1. DELIVERY AND TRANSFER OF GOODS TO THE BUYER

5.1. The Seller delivers the Goods to the Buyer using one of the methods specified on the Online Store website.

5.2. If the distance sales agreement (hereinafter, the “Agreement”) provides for delivery of the Goods to the Buyer, the Seller must deliver the Goods within the period established by the Agreement to the location specified by the Buyer. If the Buyer does not specify a delivery location, the Goods must be delivered to the Buyer’s place of residence or registration.

5.3. The Buyer specifies the delivery location when placing the Order.

5.4. The delivery period consists of the Order-processing period and the delivery period.

5.5. The delivered Goods are transferred to the Buyer or, if the Buyer is absent, to any person who presents a receipt or another document confirming conclusion of the Agreement or arrangement of the delivery.

5.6. Information about the Goods is provided to the Buyer in the technical documentation supplied with the Goods, on labels, through markings, or by another method customarily used for the relevant type of Goods.

5.7. Information about mandatory confirmation of conformity of the Goods is provided in accordance with the procedures and methods established by the technical-regulation legislation of the Russian Federation. This information includes the number and validity period of the conformity document and the name of the organization that issued it.
